This is interesting. I wonder how long this CPS guidance has been in place? The law has been very strict about deception as to sex cases, which carry a substantial sentence in the scheme of things, and trans identified men in particular seem to have been getting cross about it, believing that there should be exceptions for them. What a surprise.

My bad - doc says

  1. Any request for a direction under s.85A(3)(b) of the Courts Act 2003 (“a transmission
direction request”) by a person not taking part in the proceedings (“an applicant”) for permission to watch or listen the hearing of the above proceedings on 8 and 9 July 2026 must be made by 10am on Monday 6 July 2026.
  1. Any transmission direction request should be sent by email to the Administrative Court
List Office at

[email protected] and must include the
following:

a. b. c. The full name of the applicant;

The email address of the applicant;

Whether the applicant would be located within the jurisdiction of England and
Wales at all times when attending the proceedings remotely (if a transmission
direction were to be made);

and, if not, details of the applicant’s location;d.

e. Any information the applicant wishes to provide in support of the request, including
in particular any reason(s) why it is contended that making such a direction would
be in the interests of justice; and

A statement made by the applicant in the following terms: “If permitted to attend
the hearing remotely, I understand and undertake to the Court that I will not make
a recording, capture images, and/or broadcast any part of the proceedings. I
understand that to do so would be an offence and may be a contempt of court, and
that I may be punished if I were to do so”.

  1. Unless exceptionally the Court otherwise directs, a transmission direction request made
otherwise than in accordance with this Order will not be granted

We will not be covering this one. We have a couple of members out of action at the moment and Tempest will keep us busy through the week. I think Nick Wallis may cover although legal argument is the least amusing to report.

Who is the onus on to verify/reveal sex? Obviously no one should lie if asked and I've no idea whether people routinely do ask these days.

If you can say you only consent to lesbian sex can you also say you only consent to monogamous sex? Then take cheating DP to court?

This will be interesting.
The CPS have (or had) some exceptionally dubious staff who've been allowed to run amok writing dodgy trans guidelines for schools that had to be binned rather than face exposure & challenge via a judicial review, this issue seemingly promoted by "self interested" staff plus making some very unsuitable staff appointments.

I'm pretty sure deception as to sex is far more likely to be used by women pretending to be men than the other way round (though that may be down to how few TIMs actually pass).

There was a recent case where a TIM received a prison sentence - but as you say it’s mostly been women.

I think that the only way for me to observe Sandie Peggie and the other tribunals was on a desktop: it didn’t work on my iPad or iPhone.

Did anyone else have the same problem? I may need to ban DH from his office where the computer is.

As before, iPad access didn't work, although it did when I tried a test call. On the desktop I got in really quickly .

I think it's showing that this court is much more used to remote access than the tribunal hearings are, as you'd expect.
